Enea SAOstroleka power plant illegally withdraws from construction of unit C; covers PLN 958 mln in claims
The withdrawal of Elektrownia Ostroleka power plant from the construction of the Ostroleka C coal-fired power plant and the coverage of the general contractor's claims in the amount of over PLN 958.1 million (EUR 224.7 mln) net were illegal; this is contrary to the terms of the contract and uneconomical, according to an audit carried out by Poland's Supreme Audit Office (NIK).
In the opinion of the Office, the management board violated the interests of Elektrownia Ostroleka by failing to properly protect the assets entrusted to it.
According to the NIK, the reason for such actions was the desire to settle the investment as quickly as possible, which was to enable the start of another investment – the construction of a steam and gas unit, in which natural gas is to be used for electricity production instead of coal.
"In connection with the findings of the audit, the NIK is preparing a notification to the prosecutor's office of a suspected crime consisting of causing significant financial damage to Elektrownia Ostroleka by members of its management board in connection with their failure to fulfil their duties," the statement said.
It was reported that the audit also showed that the company's management board misled investors, namely Enea and Energa (each holding a 50 percent stake in Elektrownia Ostroleka), by providing them with incomplete and false information about the settlement and completion of the Ostroleka C investment.
