JSW SAPoland's climate ministry refuses to initiate JSW coal's solidarity contribution refund
Poland's Minister of Climate and Environment refused to initiate proceedings regarding listed coking coal manufacturer JSW's request for a determination of overpayment and refund of the solidarity contribution, the company announced in a market filing.
According to the filing, in the opinion of the Ministry of Climate and Environment, the refusal to initiate proceedings is due to its lack of competence to assess the constitutionality of the act, which, in its opinion, is the exclusive competence of the Constitutional Tribunal.
"This decision may be appealed for reconsideration. The company may also lodge a complaint against this decision with the Provincial Administrative Court in Warsaw, without exercising its right to request the Minister to reconsider the case, within 30 days of the date of delivery of the decision," the statement reads.
The company announced that it would appeal the decision of the Minister of Climate and Environment.
In April, Jastrzebska Spolka Weglowa submitted a request to the Minister of Climate and Environment for a determination of overpayment and a refund of the solidarity contribution in the amount of PLN 1.6 billion (EUR 375 mln).
The company paid the contribution on the basis of the Act of October 27, 2022 on extraordinary measures to limit electricity prices and support certain consumers in 2023.
