EC takes Poland to CJEU over digital act and road charge law
The European Commission (EC) has announced it is referring Poland to the Court of Justice of the European Union (CJEU) due to its failure to implement the Digital Services Act (DSA) and the Eurovignette Directive revised road toll law.
Brussels stated on Wednesday that Poland has not yet designated a Digital Services Coordinator and granted them the necessary powers to supervise and enforce the DSA.
Under the act, member states were required to do so by February 17, 2024. Alongside Poland, the Czech Republic, Cyprus, Spain, and Portugal are also facing legal action.
The DSA introduces rules for online content moderation addressing illegal content, transparent advertising and disinformation.
Furthermore, Poland, along with Bulgaria and Greece, failed "to transpose EU rules on the charging of vehicles for the use of certain infrastructures" by the deadline of March 25, 2024, the EC stated.
The so-called Eurovignette Directive introduces a CO2 variation of road charges in Europe to accelerate the transition to carbon-neutral road freight transport.
