Poland called again by EC to send final updated climate and energy plan

The European Commission has decided to send so-called reasoned opinions to Belgium, Estonia, Croatia, Poland and Slovakia for failure to submit the final updated national energy and climate plans (NECPs; Polish: KPEiK) in accordance with EU Regulation 2018/1999 on Governance of the Energy Union and Climate Action, the EC said in a press statement.


The so-called reasoned opinion is the second step in the EU infringement procedure - now Poland and the other countries have two months to remedy the situation, otherwise the EC may refer the case to the CJEU.

The EC, informing on the decision taken, added that the final updated National Energy and Climate Plans are key tools to ensure that Member States set out a concrete action plan for achieving agreed EU targets on greenhouse gas emission reductions, renewable energy and energy efficiency, among others.

"They also enable the European Commission to assess where Member States stand as a whole on the path towards meeting the 2030 climate and energy targets. Under Article 14(2) of the Energy Union Governance Regulation, all Member States were to submit their final updated final updated national energy and climate plans (NECPs) by June 30, 2024. To date, the Commission has received 22 final plans," the EC stressed.

The Commission said that following an extensive exchange of information following the submission of the draft plans and the adoption of the EC's recommendations to Member States in November 2024, the Commission had issued letters of formal notice to 13 Member States for failure to submit final updated NECPs.

"After analysing the responses and as these five Member States have not yet submitted final updated NECPs, the Commission has decided to address reasoned opinions to Belgium, Estonia, Croatia, Poland and Slovakia," the EC said.

"These five Member States now have two months to remedy the situation and submit their final updated NECPs to the Commission. Failing this, the Commission may decide to refer the cases to the Court of Justice of the European Union," the Commission concluded.
