Poland records over 202.2k CHF loans cases pending at end-Q3 2024 - justice ministry

After the third quarter of 2024, the total number of CHF loans cases pending was 202,241 and in the third quarter alone, a total of 89,934 cases were submitted to courts of both instances, Poland's Ministry of Justice said in its comments to the draft regulation.


"According to the statistics of the Ministry of Justice for the third quarter of this year, the total number of CHF loans cases pending settlement is 202,241. In the third quarter of 2024, a total of 89,934 cases related to CHF loans were submitted to courts of both instances," the ministry of justice wrote in its comments on the draft regulation extending the non-collection of income tax in respect of settlements reached between banks and consumers in CHF loans cases.

"The jurisprudential situation is particularly difficult in the appellate courts, where the inflow of cases in the last three quarters has increased by 27.6 percent compared to the first three quarters of last year," it added.

The ministry reported that the average inflow containment ratio for the second instance courts was only 38.6 in the third quarter of 2024.

"This means that out of 100 cases received by the second instance courts, only slightly more than 38 are settled," it explained.

Of all CHF loans cases, 71,494 are heard within the Warsaw Appellate Court, of which 44,771 are pending in the Warsaw District Court.

Poland's Ministry of Justice estimates that in 2024, the courts have upheld more than one-fifth of complaints for protracted proceedings, which is an increase given that in 2020 the rate was around 10 percent.

Dialogue with the judicial community indicates that a further increase in the uptake of complaints for protraction is to be expected.
