Poland's labour ministry works on increasing protection against mobbing

Polish Ministry of Family, Labour and Social Policy (MRPiPS) is working on increasing protection against mobbing. The ministry has prepared a related project, which is waiting to be included in the government's list of legislative works, the MRPiPS said in a statement.


"Simplifying the definition of mobbing and recognising that its basic feature is to be the persistent harassment of an employee - this is the most important assumption of the draft law created at the Ministry of Family, Labour and Social Policy," it was written.

"The proposed definition of the phenomenon assumes making the determination of the existence of mobbing independent of the intentionality of the perpetrator's action or the occurrence of a specific effect, and also excludes incidental and one-off behaviours," it added.

The draft also assumes the necessity to set out the principles of counteracting mobbing and discrimination in work regulations and imposes an obligation on the employer to apply preventive measures, detect and respond to mobbing and support victims of mobbing.

In addition, the draft provides for exemption from civil liability of the employer if the bullying did not originate from the employee's superior and appropriate preventive measures have been implemented, as well as establishing a minimum threshold for compensation for bullying of six monthly salaries.

As stated in the release, the project is now waiting to be included in the government's legislative work list.
