Poland to grant permit for preliminary work on nuclear power plant's construction - draft
The new regulations are intended to enable the investor to obtain a permit for preliminary work on the construction of a nuclear power plant, which is expected to reduce the risk of investment delays, according to draft amendments to the act on the preparation and execution of investments in nuclear power facilities.
"The draft law proposes the introduction of solutions that will streamline the process of preparing the implementation of investments in nuclear power facilities or accompanying investments, which will reduce the risk of delays in the preparation and implementation of these investments and give the possibility of their faster completion," the office of the deputy minister responsible for nuclear power sector Wojciech Wrochna wrote in the regulatory impact assessment.
Under the new regulations, before obtaining a construction permit for the entire nuclear power plant, the investor will be able to apply for a construction permit for preliminary construction works.
This will be issued by the provincial governor according to the rules and procedure set out in the construction law.
The works in question are, among others, excavations for the construction site, the drainage of the site, the construction of fire protection tanks or the construction of a road for heavy transport on the site.
As the authors of the draft noted, currently, under the construction law, a building permit applies to the entire construction project.
"The current regulations allow the construction of a part of a construction project only if it consists of more than one object, and at the same time, the selected object or set of objects can function independently," they pointed out.
It added that to improve the efficiency of the complex investment and construction process for nuclear power facilities, the possibility of phasing the investment should be increased, so that those parts that cannot function independently can also be executed.
"The introduction of legal solutions in this regard will benefit the efficiency of the process of construction of nuclear power facilities, including nuclear power plants (…), which, according to international experience, has a high risk of delays," the regulatory impact assessment stated.
The draft was made available for inter-ministerial consultation by the deputy minister, government plenipotentiary for strategic energy infrastructure Wojciech Wrochna on Tuesday; there are 21 days for comments.
