Poland with warning notice from EC on incomplete implementation of Waste Framework Directive
On Thursday, the European Commission initiated proceedings for violation of EU law by Poland for incomplete implementation of EU waste disposal regulations, within the Waste Framework Directive. According to the EC, Warsaw has been issued with a notice to implement the rules.
The case concerns the incorrect implementation of landfill regulations. Under EU law, member states must ensure that only pre-treated waste is sent to landfills and limit landfilling of municipal waste to 10 percent by 2035.
The EC notes that Poland has not implemented adequate rules for calculating landfill rates and has not introduced all requirements for the storage of metallic mercury and the monitoring and control of landfills - both during their operation and after closure.
According to the EC, this could have a negative impact on the environment and the health of local residents, especially in the immediate vicinity of the landfills.
Poland now has two months to respond. In the absence of a satisfactory response, the EC may proceed to the next stage of the procedure and, in a further step, take Poland to the Court of Justice of the European Union (CJEU).
