Tauron PE SAClaims against Tauron power entirely dismissed by court
The Regional Court in Katowice has announced a verdict dismissing the claims of the Gorzyca Wind Invest lawsuit in its entirety, including all its extensions against listed power group Tauron, Tauron said in a market filing.
As indicated, Gorzyca Wind Invest demanded the payment of damages (originally in the amount of PLN 39.7 million or EUR 9.3 mln and subsequently extended) and the determination of liability for damages that may arise in the future from tortious acts, including acts of unfair competition, with a value estimated in 2017 by Gorzyca Wind Invest at PLN 465.9 million (EUR 109.1 mln).
It was reported that the factual basis for the claim, according to Gorzyca Wind Invest's allegations, was to be Tauron's alleged tortious acts related to the termination of long-term contracts for the purchase of electricity and property rights resulting from certificates of origin.
Tauron added that in the oral recitals of the judgment, the court shared Tauron's position as to the absence of both the principle of the company's liability and its specific grounds, cited by Gorzyca Wind Invest.
