Polish government adopts bill to optimize and simplify central transportation hub CPK investments
Polish government approved a bill to simplify and improve the investment process for Poland's central transportation hub, CPK. The law introduces changes to location decisions, compensation procedures, and sets clear deadlines for expropriation and payouts.
According to the project assumptions, a new structure for location decisions will be introduced.
"Currently, a location decision does not automatically trigger compensation proceedings for expropriated property. After the change, this decision will be immediately enforceable," the document states.
"This will result, among other things, in the commencement of proceedings to determine the amount of compensation and the possibility for CPK to dispose of the property for construction purposes," it added.
A minimum deadline for the release of the property will also be introduced.
The regulations will also specify a deadline for the provincial governor to determine the amount of compensation.
"Currently, there is no clear deadline for issuing this decision. Thanks to the new regulations, the provincial governor will have to determine the amount of compensation within: 30 days from the date on which the location decision became final, or 60 days from the date on which the location decision became immediately enforceable," it was written.
According to the government information centre CIR, after the introduction of the new regulations, more people will be eligible for an advance payment towards compensation.
"In addition to owners of properties with buildings, this will also include owners of undeveloped properties. A person entitled to compensation will be able to apply for an advance payment of 85 percent of the compensation determined by the first instance authority. The advance payment will be paid within 30 days of submitting the application," the announcement stated.
