Poland refers draft with price cap for offshore to governments legal committee
After renewed consultations with the Ministry of State Assets MAP and the Ministry of Finance, the climate ministry has referred a draft regulation on the maximum prices for energy from offshore wind farms that can be indicated in auctions to the legal committee of the government legislation centre RCL. These prices have not been changed in the new draft.
"Given the planned first auction in 2025, and bearing in mind the need to meet the milestone of the national recovery and resilience plan, the regulation should enter into force immediately," stressed the climate ministry in a letter to the RCL requesting that the draft be referred to the legal committee.
The RCL recalled that the draft was subject to two consultations with other ministries.
"On December 31, 2024, a reconciliation meeting was held with representatives of the Ministry of Climate and Environment, the Ministry of Finance and the Ministry of State Assets, during which the negative and at the same time conflicting opinions of the MAP and MinFin were discussed," wrote the climate ministry
It added that the draft regulation will remain in the wording given after inter-ministerial agreements, opinions and public consultations, which means no changes with respect to the draft published on Christmas Eve.
The draft lists three maximum prices for electricity generated in an offshore wind farm and injected into the grid that can be indicated in bids submitted in an auction.
These are:
1) PLN 485.71 (EUR 113.66) per MWh - for areas located on the closer Odra Shoal and on the eastern part of the Slupsk Shoal;
2) PLN 499.33 (EUR 116.84) per MWh - for areas located on the western part of the Slupsk Shoal;
3) PLN 512.32 (EUR 119.88) per MWh - for areas located on the further Central Shoal.
The project's RIA indicates that the greater distance from the coastline also affects higher operating costs.
It added that the first auctions, during which the right to cover the negative balance may be granted, have been scheduled in 2025, 2027, 2029 and 2031 (4 GW, 4 GW, 2 GW, 2 GW respectively), while auctions in subsequent years will be held depending on the progress of offshore wind energy development in Poland.
