Listed rail hauler PKP Cargo intends to file a claim in autumn for damages incurred in connection with the Prime Minister's so-called coal decision of 2022, citing the right to full remuneration and compensation in a situation of force majeure, as announced in the Polish Lower House Sejm by the company's CEO, Agnieszka Wasilewska-Semail.
During a meeting of the Sejm Infrastructure Committee, the CEO of PKP Cargo stated that the coal decision had both direct positive effects (remuneration for coal transport) and direct negative effects, such as penalties for non-performance of contracts.
She added that there were also indirect negative consequences, including customers withdrawing from contracts or reducing the volume of cargo transported, as well as lost profits and unused capital expenditure, e.g. on prepared but unused coal wagons.
"As far as the coal decision is concerned, we cannot tell you exactly what financial impact this decision has had on the company, as we are in the final stages of analysis. We are working with a reputable law firm, a reputable industry consultant and a scientific institute," said the head of PKP Cargo.
"In autumn of this year (...) we will file a claim for damages that has been directly or indirectly caused to the company," she announced.
