Polish govt plans to adopt EU Energy Efficiency Directive implementation in Q3 2025

The Polish government aims to adopt a draft law in the third quarter of 2025 to implement the EU directive on energy efficiency into national legislation, according to the Council of Ministers' legislative work schedule.


The draft aims to implement measures to promote energy efficiency, ensuring the achievement of the 2030 energy efficiency targets under Directive 2023/1791 and further energy efficiency improvements beyond 2030.

The draft will take into account the obligation to apply the 'energy efficiency first' principle by adding a provision obliging the investor to perform an analysis of energy efficiency solutions in the case of projects or investments exceeding a budget of EUR 100 million (EUR 175 million in the case of transport infrastructure projects). The performance of the analysis will apply to investments (within the above investment threshold) in all sectors of the economy.

An obligation will also be imposed on public institutions to reduce their total final energy consumption by 1.9 percent per year compared to 2021 and to implement a system for monitoring and reporting obligations in this regard.

In addition, the proposals envisage a modification of the energy efficiency certificate system, including in particular: streamlining the rules for calculating energy savings and verifying and controlling the energy savings achieved.

The solutions also assume the establishment of a regulated profession of an energy efficiency auditor and thus transferring the burden of verification of audits from Poland's energy market regulator URE to auditors, which will not only streamline the process of their verification, but also contribute to improving the quality of energy efficiency audits - the digitalisation of the system of energy efficiency certificates.

In addition, modifications to the central register of final energy savings (CROEF) are envisaged, including: ensuring the operation of the CROEF in the long term, tidying up the way in which authorised persons are entered into the CROEF, -extending the information collected in the register to properly authenticate persons entering data into the CROEF, extending the information collected in the register to show the total amount of final energy savings achieved, reported as part of the achievement of the national final energy savings target, from alternative measures and from energy efficiency certificates.

The new legislation also envisages the introduction of a provision making it mandatory to implement a certified energy management system for enterprises whose average annual energy consumption over the last three years, considering all energy carriers, exceeded 23.61 GWh (85 TJ).

It is also planned to modify the existing provisions regarding the obligation to carry out an energy audit to enterprises whose average annual energy consumption over the last 3 years, considering all energy carriers, exceeded 2.78 GWh (10 TJ).
